This policy explains what personal data Herrera & Flamenco Abogados may process, how we use it, and how you can exercise your rights.

Summary: we use the data you provide to respond to inquiries, deliver legal services, administer this website, and publish institutional content. We do not sell personal data. You may request access, updating, correction, or deletion by writing to eherrera@esderecho.com.ar.

1. Scope and data controller

This Privacy Policy applies to the website www.esderecho.com.ar, the firm’s forms and contact channels, and the technology integrations used to manage its content and social media accounts.

The data controller is Herrera & Flamenco Abogados, located at Arturo M. Bas 136, 6th Floor, Office C, City of Córdoba, Republic of Argentina. For privacy or data protection inquiries, you may write to eherrera@esderecho.com.ar.

Personal data is processed in accordance with Argentine Personal Data Protection Law No. 25,326, its implementing regulations, and other applicable rules.

2. Data we may collect

Depending on how you interact with the firm, we may process the following categories of information:

  • Identification and contact details: first name, last name, email address, telephone number, location, and any other information you choose to provide.
  • Inquiry information: area of law, description of the matter, messages, and documents you voluntarily submit.
  • Professional relationship data: information required to assess, engage, manage, and document the provision of legal services.
  • Technical data: IP address, browser and device type, date and time of access, pages visited, security logs, and cookie identifiers.
  • Social media data: account, page, or organization identifiers; administrative roles; content; posts; and metadata strictly required to operate authorized integrations.

Legal inquiries: please do not send sensitive documents or third-party information through open forms before the firm provides you with an appropriate channel. Submitting an inquiry does not, by itself, create an attorney-client relationship.

3. How we obtain data

We may obtain information directly from you when you complete a form, contact us by email or WhatsApp, call the firm, request a meeting, or engage our services. We may also receive technical data generated by the operation of the website and data provided by third-party platforms when you expressly authorize an integration.

Providing information through our forms is voluntary unless otherwise stated. If you do not provide information identified as necessary, we may be unable to respond to your inquiry or provide the requested service.

4. Purposes of processing

We process personal data to:

  • Respond to inquiries and communicate with people who contact the firm.
  • Assess potential matters and provide legal services.
  • Manage relationships with clients, suppliers, and collaborators.
  • Administer, protect, and improve the website and its forms.
  • Prevent abuse, spam, unauthorized access, and security incidents.
  • Comply with legal, professional, accounting, and regulatory obligations.
  • Create, schedule, and publish institutional content on our own channels and social media accounts.
  • Measure the general performance and reach of our content when the tools we use allow us to do so.

We do not use information received through legal inquiries to train artificial intelligence models, nor do we publish it on social media.

5. Legal grounds and consent

Depending on the circumstances, processing may be based on your consent, pre-contractual steps taken at your request, performance of a professional relationship, compliance with legal obligations, or legitimate interests relating to the firm’s security, administration, and institutional communications.

Where processing is based on your consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out beforehand, nor does it affect data that we must retain to comply with a legal obligation or to establish, exercise, or defend legal rights.

6. LinkedIn integration

Herrera & Flamenco Abogados may use its own application to publish institutional content on the firm’s LinkedIn company page. The integration works through the OAuth protocol: an authorized administrator signs in directly to LinkedIn and grants specific permissions. The firm does not receive or store the administrator’s LinkedIn password.

For this purpose, the application may process:

  • Basic identification details for the administrator account authorizing the connection.
  • The identifier of the Herrera & Flamenco Abogados page and the roles required to verify authorization.
  • Access tokens and technical data required to maintain the connection.
  • Text, images, links, and other content the firm chooses to publish.
  • Post identifiers, dates, status, and basic metrics when provided by the authorized API.

The integration is used exclusively to manage the firm’s institutional presence. It is not used to sell information, create profiles of individuals, monitor users, make automated decisions about them, or publish client data. We do not request access to LinkedIn members’ private messages.

Permissions may be revoked through your LinkedIn account settings. You may also request deletion of data associated with the integration by writing to eherrera@esderecho.com.ar with the subject line “LinkedIn data deletion request.” Upon receiving a valid request, we will delete or anonymize information that we are not required to retain and revoke the relevant tokens.

Your use of LinkedIn is also subject to the LinkedIn Privacy Policy and its terms of use.

7. Cookies and technical data

The website may use technical cookies that are necessary for its operation, security, and retention of preferences. It may also use analytics tools to understand, in aggregate, how the website is used. Where required, we will request consent before activating non-essential cookies.

You can block or delete cookies through your browser settings. Some features of the website may not function correctly if you disable technical cookies.

8. Recipients and service providers

We do not sell or rent personal data. We may allow it to be processed only by professionals and service providers that need access in order to provide services to the firm, such as web hosting, email, maintenance, security, forms, automation, and social media services.

These service providers must use the information solely for the assigned purpose and maintain reasonable confidentiality and security measures. We may also disclose data when required by law or an order from a competent authority, or when necessary to establish, exercise, or defend legal rights.

9. International transfers

Some technology service providers or platforms, including LinkedIn, may process information outside Argentina. In such cases, we seek to use services that provide appropriate privacy and security commitments and to implement the safeguards required by applicable law.

10. Retention

We retain data for as long as necessary to fulfill the purpose for which it was collected and, thereafter, for the periods required by legal or professional obligations or by the need to establish, exercise, or defend legal rights.

Integration access tokens are retained while the authorization remains valid or until they expire or are revoked. Post metadata is retained for as long as it is necessary to manage institutional channels. When data is no longer necessary, it is deleted, anonymized, or blocked, subject to technical and legal requirements.

11. Security and confidentiality

We implement reasonable technical and organizational measures to prevent the loss, alteration, unauthorized access, disclosure, or processing of information. Access is limited to those who need it to perform their duties. However, no system connected to the Internet can guarantee absolute security.

Information received within a professional relationship is also handled in accordance with the legal and ethical duties of professional secrecy and confidentiality applicable to legal practitioners.

12. Your rights

You may request information, access, updating, correction, confidentiality, or deletion of your personal data. To do so, write to eherrera@esderecho.com.ar and provide your name, contact details, the right you wish to exercise, and the information necessary to verify your identity.

The right of access may be exercised free of charge at intervals of no less than six months, unless you can demonstrate a legitimate interest. Requests for access will be answered within ten calendar days, and requests for correction, updating, or deletion within five business days, in accordance with applicable law.

Argentina’s Agency for Access to Public Information (Agencia de Acceso a la Información Pública), the supervisory authority for Law No. 25,326, receives complaints and claims regarding breaches of personal data protection rules. 13. Data relating to children and adolescents

The website is not specifically directed at minors. If an inquiry involves a child or adolescent, information should be provided by a person who has legal authority to represent them or otherwise has sufficient standing, and only to the extent necessary to obtain legal guidance or assistance.

14. Third-party links and services

The website may contain links to external services. Herrera & Flamenco Abogados does not control the privacy practices of those websites, and we recommend reviewing their policies before providing them with information.

15. Changes to this policy

We may update this Privacy Policy when our practices, the tools we use, or applicable law change. The current version will always be available on this page and will display the date of its latest update.
