What we do

Everything your trademark needs, end to end.

Filing before the INPI

Registrability search, filing, prosecution of the application and the certificate of registration, valid for ten years and renewable.

Clearance search

We tell you whether your mark is available in the class you need before you spend a dollar on it.

Oppositions and renewals

If somebody opposes your application, or you need to oppose a third party’s mark that comes too close to yours.

Trademark watch

The first year is included. After that, affordable plans so nobody registers something similar without you hearing about it.

Step by step

How do I register my trademark?

Four steps, all of them handled by us. You do not need to travel to Argentina or appoint anyone else.

1

Registrability search

We check whether your mark is available in the class of goods or services you need, whether a similar mark could give rise to an opposition, and whether it meets the legal requirements.

2

Filing

We file before the INPI and pay the official fee, which is already covered by our flat rate. Filing through a specialist avoids the errors that lead to refusal or to a registration that does not cover what you sell.

3

Prosecution

Publication in the trademark bulletin and the administrative stages through to registration. We keep you posted at every step.

4

Certificate

If there are no oppositions within the legal term, or they are overcome, the INPI grants the mark. You get the certificate, valid for ten years and renewable, plus one year of trademark watch at no cost.

Want to know whether your mark is free?

We run the clearance search before filing anything. Send us the name and we will come back to you.

Frequently asked questions

What people ask us most.

Do you patent or register a trademark?
Trademarks are registered, not patented. What you patent is an invention: a new product or process that solves a technical problem. If what you want to protect is the name, the logo or the tagline you sell under, what you need is trademark registration before the INPI, which is what this page is about.
Do I need to be based in Argentina to register a trademark there?
No. Foreign individuals and companies can hold Argentine trademarks. What the law does require is a local address for service, which we provide as your agents, and a power of attorney that we prepare and send you. The whole process is handled remotely.
Why register your trademark?
Your trademark is an essential part of your business, and registering it before the INPI turns it into an asset of your company. It is the only legal way to protect it against third parties: if you do not register it, someone else can use it or even lawfully take ownership of it, even where you used it first. A registered trademark gives you exclusive use across Argentina, standing to take legal action if you are copied, commercial value for franchising, licensing or sale, and the legal certainty to invest and grow.
What is a trademark?
A trademark is any sign that distinguishes goods or services and helps tell them apart from others of the same kind, under section 1 of the Argentine Trademark Act. According to the INPI (the National Institute of Industrial Property) you can register words, names and phrases; logos and graphic designs; combinations of image and text; distinctive colours; and, in special cases, sounds or recognisable containers. You can also register your own name or stage name.
What makes a sign registrable as a trademark?
Distinctiveness: it has to identify a product or a service. Availability: it has to be free to take. Novelty: it has to be new in relation to those goods or services.
What rights does registration give you?
The right to exclude: the owner can stop anyone who is not authorised from using the mark. The right to assign: the owner can transfer the mark to someone else. The right to license: the owner can grant a licence of use to an interested third party. And the right to oppose: the owner can oppose the registration of a third party’s mark that is similar or identical to theirs.
What does it cost to register a trademark?
US$400 per class, with the official INPI fee already included, and US$200 for each additional class. That covers the clearance search, the filing, prosecution through to registration and the certificate. If an opposition comes up, we quote it separately before doing any work on it.
What happens if you do not register your trademark?
You can lose the right to use it lawfully. Someone else can register it first and force you to stop using it. You cannot act against copies or knock-offs. And you cannot assign or franchise it. Registering your trademark is an investment, not an expense.
